Article 1 – Definitions
In these terms, the following definitions apply:
•WKM.ai: The provider of photo editing services.
•Customer: The person or organization using WKM.ai’s services.
•Services: The photo editing and related services offered by WKM.ai.
Article 2 – Applicability
These terms and conditions apply to all services provided by WKM.ai. By using WKM.ai’s services, the customer agrees to these terms.
Article 3 – The Offer
WKM.ai’s offer consists of online photo editing for the automotive sector. The services offered may change at any time.
Article 4 – The Agreement
The agreement is concluded when the customer places an order for WKM.ai’s services. There are no recurring monthly fees; the costs are based on what is actually ordered.
Article 5 – Right of Withdrawal
WKM.ai offers an online photo editing service, for which the right of withdrawal does not apply. This applies to future orders as well. By using WKM.ai’s services, the customer acknowledges that withdrawal is not possible.
Article 6 – Consumer Obligations During the Cooling-Off Period
Since there is no right of withdrawal, there are no obligations for the customer during the cooling-off period.
Article 7 – Exercising the Right of Withdrawal by the Consumer and Related Costs
There is no right of withdrawal for WKM.ai’s services, as it is a digital photo editing service.
Article 8 – Delivery and Execution
All edited photos are delivered in a 2-step feedback process:
•Step 1: The photos are automatically edited by software within 2 hours and are immediately visible.
•Step 2: The photos are manually reviewed within 24 hours and, if necessary, adjusted. The final, reviewed photos are then made available via the platform.
Article 9 – Exclusion of Right of Withdrawal
The right of withdrawal is excluded, as described in Article 5.
Article 10 – The Price
The prices for WKM.ai’s services are exclusive of VAT and are stated on the website and in the quote. Additional charges may apply for extra requests, such as additional edits or services.
Article 11 – Compliance and Additional Warranty
WKM.ai will deliver the services to the best of its ability. If a photo does not meet the customer’s specifications, WKM.ai will re-edit the photo to meet the agreed requirements.
Article 12 – Delivery and Execution
The delivery of the edited photos takes place within 24 hours, with the two-step editing process as described in Article 8.
Article 13 – Duration Transactions: Duration, Cancellation, and Renewal
No subscriptions are sold. Each order is treated as an individual transaction.
Article 14 – Payment
Payment for WKM.ai’s services is made in advance through the available payment methods. An option to pay on account can be requested by businesses. In this case, the customer will receive an invoice at the beginning of each month for the services rendered in the previous month.
Article 15 – Complaint Procedure
If there are complaints about the services provided, the customer can send an email to info@wkm.ai. WKM.ai will investigate the complaint as quickly as possible and try to resolve it.
Article 16 – Disputes
Any disputes between the customer and WKM.ai will be submitted to the competent court in the Netherlands.
Article 17 – Industry Guarantee
WKM.ai is currently not affiliated with any specific industry organization, as the AI technology we use for photo editing is a relatively new and rapidly evolving field. AI in the automotive sector does not have a formal industry association, but WKM.ai strictly follows applicable laws and regulations and strives to uphold the highest standards of quality and ethics in the technology we provide.
Article 18 – Additional or Deviating Provisions
Deviations from these terms and conditions are only valid if agreed upon in writing.
Article 19 – Modification of Terms and Conditions
WKM.ai reserves the right to modify the terms and conditions. Changes will be published on the website and will be effective as soon as the customer places a new order.
